These Terms & Conditions (“Terms”) govern your access to and use of the RemindMeRx mobile application (the “App”) and the website/web application located at www.mysticktracker.com (the “Site”), including any related services (collectively, the “Services”), provided by Zen Software Solutions LLC (“Company,” “we,” “us,” “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

You must be at least 13 years old to use the Services (or 16 in certain regions). If you are using the Services on behalf of an organization, you represent you have authority to bind that organization to these Terms.

A. App Store / Google Play Subscriptions

If you purchase a subscription through the App, billing is handled by the platform provider (e.g., Apple App Store / Google Play). Your purchase is subject to that platform’s terms and policies, and subscription management (including cancellations) must typically be handled through your app store account settings.

B. Web Payments (If Offered)

If paid features are available on the Site, payments may be processed by a third-party payment processor. You authorize us and our processor to charge the payment method you provide for the amounts due.

C. Renewals and Cancellations

Subscriptions may renew automatically unless canceled before the renewal date. Cancellation stops future charges but does not retroactively refund prior charges except where required by law or platform policy.

D. Refunds

Refunds are handled according to the applicable platform or payment processor’s policies and any mandatory consumer protection laws.

4) License and Acceptable Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business use (as applicable), subject to these Terms.

You retain ownership of your User Content. However, you grant us a worldwide, non-exclusive license to host, store, process, and display your User Content solely to provide and improve the Services and to fulfill our obligations under these Terms.

You represent that you have all rights needed to provide User Content and that it does not violate any law or third-party rights.

RemindMeRx is not a medical device and does not provide medical advice. The Services may help you track reminders and information, but they are not a substitute for professional medical judgment, diagnosis, or treatment.

7) Service Availability and Changes

We may modify, update, suspend, or discontinue the Services (in whole or part) at any time. We do not guarantee the Services will be uninterrupted, error-free, or available at all times.

The Services, including software, design, logos, trademarks, and all related content (excluding User Content), are owned by Zen Software Solutions LLC or its licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Services unless we give you written permission.

9) Third-Party Services and Links

The Services may integrate with or link to third-party services (e.g., payment providers, app store subscription services, analytics). We are not responsible for third-party services, and your use of them may be subject to their own terms and policies.

10) Privacy

Your use of the Services is also governed by our Privacy Policy. If these Terms conflict with the Privacy Policy, these Terms control for contractual matters and the Privacy Policy controls for privacy/data handling disclosures.

You may stop using the Services at any time.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, or error-free, or that defects will be corrected.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZEN SOFTWARE SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

You agree to indemnify and hold harmless Zen Software Solutions LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to:

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

You agree that any dispute arising out of or related to these Terms or the Services will be brought in the state or federal courts located in Florida, and you consent to personal jurisdiction and venue there.

16) Changes to These Terms

We may update these Terms from time to time. We will update the “Last Updated” date and may provide additional notice if changes are material. Your continued use of the Services after changes means you agree to the updated Terms.
